AGCEP ACTION



The District calendar for 2009–2010 begins on Tuesday, September 1, 2009 and Wednesday, September 2, 2009.

Referring to AGCEP contract Appendix B all 39 week employees are to report to work “from day after Labor Day through last day of school for students (excluding school recesses and prof. dev. days after September each year)”

AGCEP has met with the District to address the expectations for 39 week employees regarding September 1 & 2, 2009 These two days are part of the annualized hours that are in your salary and the expectation is for all staff to report. Understanding that these days are contrary to AGCEP contract language for 39 week employees the District and AGCEP have come to a verbal agreement on June 11, 2009. Once the paperwork is final and signed 39 week members will receive a copy of the agreement.

The following terms have been agreed upon:

39 week employees expected to report to work on September 1 & 2, 2009

A form will be provided for 39 week employees to indicate whether they intend to be in attendance on those two days and if they wish to use personal and/or vacation days to be paid for these days, or if they wish to be granted authorized, unpaid deduct days.

In either case these days will not interrupt the continuity of attendance under Article XII, Section 1, E “Attendance Incentive”

This agreement is for the 2009–2010 calendar year.

SnowingEmergency Closing


Unit Members will not be deducted for Emergency Closings of District Facilities. The expectation is any regular work time that is missed due to closings will be made up by the unit member at a time to be determined by the district by the end of the school year in which the emergency closing occurred. AGCEP Contract Article VIII

The District expectation is that all employees except for students and teacher will report to work unless there is a Monroe County Travel Advisory.

If you have an extenuating circumstance that keeps you from going to work you should call your principal.

Red Kettle


AGCEP enjoys "ringing those bells"!


I would like to thank all the AGCEP volunteers who with the help of their children, grandchildren & spouses provided 15 hours of "red kettle" service for the Salvation Army at the Greece Ridge Mall. This was almost double the hours donated in 2007.

•Wednesday 12/3 Debbie Buckley & the Brookside "Bells" greeted shoppers at Macy’s north entrance from 5–7pm.
•Thursday 12/4 Deb Simms & husband were there from 5–7pm.
•Friday 12/5 Lina Lane, Tami Pignone & son and Ann Marie Paul & husband Al greeted shoppers at door #9.
•Friday 12/5 Donna Clegg, Laurie Gorton, Mary Ann Weed, Maureen Close and Bev Fisher greeted & entertained shoppers at Macy’s north entrance from 5–9pm.
•Saturday 12/16 Bernadette Petitte with her granddaughter and Lynda Boyd & Molly braved the cold again at Macy’s from 3–6pm.

Again I would like to thank all our volunteers for joining with me in giving their time to help the Salvation army raise money to help those in need in our community.

Recently both the judiciary and the legislature have had the opportunity to examine the provisions of Civil Service Law §159–b and to explicate, or clarify as the case may be, the legislative intent as to the paid nature of the leave provided by the statute.

As enacted in 2007 the complete text of Civil Service Law §159–b reads as follows:

  1. Every public officer, employee of this state, employee of any county employee of any municipality, or employee of any school district shall be entitled to absent himself or herself and shall be deemed to have a leave of absence from his or her duties or service as such public officer or employee of thus state, employee of any county employee of any municipality, or employee of any school district, for a sufficient period of time, not to exceed four hours on an annual basis, to undertake a screening for breast or prostate cancer.
  2. The entire period of the leave of absence granted pursuant to this section shall be excused leave and shall not be charged against any other leave such public officer, employee of this state, employee of any county, employee of any municipality, or employee of any school district is otherwise entitled to.

Grievance Settlements
Termination of Teaching Assistants

In June of 2001 three teaching assistants were unsuccessful at passing their probationary periods and sought to return to their previous position as teacher aides. The District refused to return them to their former classifications, and each member filed a grievance. The three grievances were consolidated into one.

The grievance was supported by the AGCEP Contract in which states “A permanent employee whose promotion results in a provisional or probationary period shall have the right to return to a vacancy in his/her former classification if he/she does not satisfactorily complete the provisional or probationary period.”(article XIV(1)).

On June 24, 2004 a mediation session was held at the PERB office in Albany at which NYSUT rep. Pat Domaratz represented AGCEP. At that time the District refused to accept the mediated recommendations and AGCEP requested that arbitration be scheduled. The District declined the request. The case was argued at the Supreme Court level twice, once in December 2004 and again in September 2006 and the decision in AGCEP’s favor was upheld both times. In June 2007 a Demand for Arbitration was filed.

In December 2007 AGCEP and the District met with the PERB Arbitrator. It was decided that AGCEP and the District would work together to come to a settlement for each employee. Agreement was made and accepted by the District for two of the grievants. AGCEP will return to arbitration on behalf of the third grievant.

July 2008 the District awarded the two grievants compensation for lost wages and terms and conditions of employment, including but not limited to health insurance, vacation, personal leave, holiday pay, attendance incentive, retirement contribution, vacation and longevity between their time of improper termination and gaining new employment.


Suit up and jump in!


Three teaching assistants in a 12:1:3 class were instructed by their classroom teacher that they were expected to assist a student during her “swimming” instruction. Referring to AGCEP contract language in Appendix C they signed a grievance that began at Step One with their Principal. The principal stated that it was considered part of their job duties under the described “other duties as assigned.”

AGCEP took the grievance to Step Two, which was not responded to within the aligned timeline. It then moved to Step Three. The Superintendent referred it to Assistant Superintendent of Human Resources. Discussion concerning the lack of training and certification was taken to the Special Ed department and it was agreed that it is NOT in a teaching assistants job duties to assist students in the pool. There should not be anymore untrained support staff suiting up and jumping in!


Chaperoning and Supervising After-hour Events

Clerical members at a high school have been paid according to AGCEP contract Article IX(7) for an after-hour event to organize an awards ceremony for students.

Contract language (Article IX.7) was not clarified in the contract from previous negotiations where it was agreed that when security staff was unavailable to “chaperone or supervise” and event other District support staff employees are assigned the extra work. Therefore, those employees would be paid the same as security workers. The words “chaperone or supervise” are not written in the contract.

During the first awards ceremony the members who had previously been paid the rate of $66.00 to work the event were told after the event that their duties were not considered chaperoning or supervising. AGCEP filed a grievance on behalf of the members. The principal agreed the language in the contract was not clear and agreed that the members would receive the $66.00 for the event already worked.

Discussion between AGCEP and Human Resources concerning the unclear language in the contract resulted in a Memorandum of Agreement between AGCEP and the District that states for future events the extra-hours request must have the terms “chaperone or supervise” for the $66.00 to be paid. All other after-hour events are to be paid at the employee’s hourly rate and time and one half after forty hours (Article IX.1-3).
